STUDENT CONDUCT

Bladen Community College reserves the right, in the interest of all its students, to decline admission, reprimand, place on probation, suspend, expel, or require the withdrawal of a student for just cause when it is deemed to be in the best interest of the College. Procedural due process will be adhered to in all cases. Students are expected to conduct themselves in accordance with generally accepted standards of conduct and to fulfill the responsibilities of their particular roles within the college community.

College students have a legal and moral right to know the specific areas of prohibited conduct and to be judged as to charges of commission of such conduct by a fair and impartial tribunal.

Set forth below are school regulations prohibiting certain types of student conduct that constitute offenses against the college community:

  1. Taking, or acquiring possession of any academic material (test information, research papers, notes, books, periodicals, etc.) from a member of the College faculty, staff, or student body without permission or any comparable violation of academic security.
  2. Stealing property, knowingly possessing, receiving or selling stolen property on campus or at any off-campus College sponsored function.
  3. Behaving in an abusive, obscene, violent, excessively noisy, intoxicated, or threatening, manner on College property or at a College sponsored function or activity.
  4. Damaging or destroying College property or property belonging to a member of the college community.
  5. Intentionally causing or attempting to cause physical injury to an employee, a student, or guest. Behaving in such a manner that could reasonably be interpreted as possibly leading to the physical injury of a College employee, student, or guest.
  6. Deliberately and knowingly passing a worthless check or money order in payment of any financial obligation to the College or College employee.
  7. Violation of College regulations regarding the operation and parking of motor vehicles.
  8. Misusing student status or right to use College property to commit, or induce another student to commit a serious violation of local, state federal laws, or any College regulation.
  9. Engaging in any conduct that causes any material disruption of any lawful function or activity of the College, engaging in conduct in which disruption is reasonably certain to result or urging others to engage in conduct where disruption occurs or is reasonably certain to occur.
  10. Illegally entering any office or building on College property or property used by the College.
  11. Bringing or using firearms, fireworks, explosives, incendiaries and all other types of weapons on College property or at any College function, (pursuant to North Carolina general statute) except on-duty law enforcement personnel or upon prior approval of the President of the College.
  12. Failing to comply with the lawful directions of instructors, administrators, or any other authorized personnel during any period of time when he/she is properly under the authority of College personnel.
  13. Hazing or harassing any student, staff member, or guest of the College.
  14. Possessing, using, transmitting, or being under the influence of any controlled substance including: narcotics, hallucinogenics, amphetamines, marijuana, alcoholic beverages, or any other intoxicants on College property or at any College sponsored function at any time. Legitimate use of prescribed drugs is not a violation.
  15. No sales, solicitations, or distributions of any kind shall be made at the college or at any college sponsored activities except those which are made to or by college officials in the normal operation of business or by the officials, meaning primary officers of college sponsored activities in the normal operation of the activity. All purchases by the college or college-sponsored activities shall be conducted through the Business Office. Those sales, solicitations, or distributions which are made by college sponsored activities must relate directly to the business of the activity. All sales or solicitations must be approved by the Executive Committee of the College. This rule is meant to include all personnel which are in any way connected with the College. 
  16. Within the limits allowed by state and federal law, including the United States Constitution, no person shall be allowed to promote that which, in the opinion of the Board of Trustees, constitutes hatred, racial prejudice or hostility, or other forms of disharmony. 
  17. No student shall participate in any form of illegal gambling while on school property.
  18. Violation of academic probation requirements.

    If the student is found guilty of violation of any of the above regulations, the Disciplinary Committee may impose any one or combination of the following penalties: 

    (Ex: 1 sem. suspension, 1 yr. probation)
     

       
    1. Expulsion-(Not being allowed to return to BCC)
    2. Suspension-(Not being allowed to return to BCC for a specified amount of time)
      1. Semester - Remainder of 16 week semester or full semester as directed by the College Disciplinary Committee.
      2. Academic Year
    3. Probation-(Behavior while at BCC under close supervision of Vice President of Student Services for a specified amount of time; student will be allowed to stay in College as long as behavior is observed).
      1. Semester - Remainder of 16 week semester or full semester as determined by appropriate College Officials.
      2. Academic Year
    4. Reprimand-(A severe or formal reproof)
CONTROL OF CONDUCT

Instructors, work supervisors, and others having charge of students, regardless of the number, have the responsibility for insuring compliance with elements of the above code. Along with this responsibility goes the following authority:

1. Where correction of a code violation can be accomplished by counseling by the official, such should  
    be done with a report of such action made to the Vice President of Student Services.

2. Where counseling fails or is not considered feasible under the circumstances, the student may be 
    immediately directed to report to the Vice President of Student Services.  In such cases, a summary of 
    the violation and reasons for referral should accompany the student and be confirmed by the referring  
    agent at the earliest  practical time. Any infraction of the conduct code, including those where 
    immediate referral is necessary, will be reported to the Vice President of Student Services by the 
    observing employee, or student as soon after the occurrence as possible.


The initial report can be oral and will be logged by the Vice President of Student Services; if requested by the Vice President of Student Services, the report will be put in writing. The report should include the specific code item violated, a brief narrative description of the occurrence, a list of witnesses, if any, and other pertinent data.

Upon receipt of a report of a conduct code violation, the Vice President of Student Services will report the incident to the Vice President of Instruction and if those two agents can positively adjudicate the matter up to the point of a probationary period not to exceed one semester in addition to the semester in which the offense occurs, they will do so, confirming this action in writing to the offender and the Executive Committee. Copies of this action will be placed in the student's folder. 

The student will be advised of his/her right to appeal to the Executive Committee.

In those cases where the Vice President of Student Services and the Vice President of Instruction feel that more formal action is necessary, they will refer the case to the Disciplinary Committee for consideration and recommendation.

The Disciplinary Committee will consider each case referred to it in formal session not later than the next school week (5 business days) after the occurrence with appearances offered to all concerned. The committee will examine evidence, call and hear witnesses, after which, they will deliberate and reach their findings in closed sessions. Such findings or recommendations for action will be determined by secret written ballot. These findings and recommendations will be given by the chairman to the Vice President of Student Services for further action within two school days after the hearing. Such findings and recommendations will be confidential until such time that they may be announced by the Vice President of Student Services or other appropriate agent. The hearing time limit can be changed by action of the Executive Committee upon request by the Vice President of Student Services or the student involved.

If a student does not meet with the Disciplinary Committee, the Disciplinary Committee shall render a decision based solely on the facts presented at the hearing.

The Vice President of Student Services, again in consort with the Vice President of Instruction, will consider the file, findings, and recommendations. If the recommendations do not include expulsion either from school or from class, the Vice President of Student Services and the Vice President of Instruction may approve recommendations and effect the corrective action(s) recommended. Such action(s) should be reported to the student, referring agent, and the Executive Committee in writing within the next school week following the receipt of hearing results. The entire record including findings, recommendations, and other action will be filed in the record of the student concerned. Rights to appeal will be included.

Where recommendations include expulsion from either a class or a program, the case will be referred to the Executive Committee for consideration at the second meeting following receipt of hearing results.

The Executive Committee will review the record, findings, and recommendations and take those actions deemed appropriate, reporting thereon to the student in question, referring agent, Vice President of Student Services, and Vice President of Instruction. This report will be sent within the next school week after the review.

The student will be advised in writing of his/her right to appeal action to the Board of Trustees. If the student wishes to appeal the action by the Executive Committee, this request for hearing will be made in writing to the President of Bladen Community College within one school week after the notice is received by the student.

During the period of evaluation, the student will be advised by the Vice President of Student Services, whether he or she may continue attending class until the case is finalized.
